Students in the 2015-2017 Master in Anti-Corruption Studies (MACS) programme finished the in-class part of their current module on Anti-Corruption, Compliance and the Private Sector last week.
Over two weeks at IACA’s Laxenburg campus, the class discussed the challenges of doing business in corrupt environments, the informal economy, effective compliance programmes, corporate social responsibility, internal investigations, and collective action. The schedule included a study visit to the Vienna International Centre for the eighth session of the Conference of the Parties to the United Nations Convention against Transnational Organized Crime (UNTOC).
Partner Luiz Dutra was interviewed about the uncertainties related to the possibility of foreign capital participation in brazilian limited liability companies. Mr. Dutra spoke about the jurisprudence as well as the academic dissent in regards to the matter. He also analyzed the legislative efforts to redress the subject.
The Brazilian Supreme Court quoted partner Ivo Gico’s paper (Princípio da eficiência e o software livre) on case (ADI n. 3.059-RS) that challenged, on constitutional grounds, a State law that forced the State’s public administration to use free and open source software.

Brazilian Federal Public Prosecutors’ Office (Ministério Público Federal) used Ivo Gico’s Law and Economics paper (Metodologia e Epistemologia da Análise Econômica do Direito) on decision regarding SBM Offshore leniency application. SBM Offshore’s leniency application is connected to alleged corruption in Petrobras’ contracts.

The 4th Federal Court of Brasília issued a third preliminary injunction to prevent the Administrative Council for Economic Defense (“CADE”) from executing the antitrust authority’s decision to fine two hospital from Feira de Santana (Brazil) and now a medical association. Both hospitals and the medical association were represented by Gico, Hadmann & Dutra Advogados.
According to the decision, given “[…] the strong evidence that CADE violated the party rights of defense, I hereby order the suspension of CADE’s decision and the financial credit originated from the administrative proceedings […]”.
The judicial proceedings now wait for CADE’s arguments.
